Abstract

Çalışma, Türkçe hukuk söyleminde koşullu yapıların yalnızca açık koşul biçimbirimleriyle değil, öncül-sonuç ilişkisi aracılığıyla metnin anlamını, uygulanma çerçevesini ve yorum alanını düzenleyen işlevsel yapılar olarak kullanıldığını ortaya koymayı amaçlamaktadır. Çalışmanın veritabanını 6100 sayılı Hukuk Muhakemeleri Kanunu’nun 1. maddesinden 452. maddesine kadar olan ana metni oluşturmaktadır. Çalışmada kanun hükümleri hukukî yorum açısından değil; koşullu yapıların hangi dilsel göstergelerle kurulduğu, öncül ve sonuç bölümleri arasında nasıl bir ilişki oluşturduğu ve sonuç bölümünün anlamını, uygulanma çerçevesini ve yorum alanını nasıl düzenlediği açısından incelenmiştir. Nitel ve betimleyici yöntemle yürütülen araştırmada verilerin seçiminde amaçlı örnekleme yöntemi kullanılmış; aynı koşulluluk göstergesinin birden fazla örneğine ulaşıldığında, ilgili yapının kullanımını en açık biçimde temsil eden örnekler seçilmiştir. Bu yönüyle çalışma, amaçlı örnekleme türlerinden tipik durum örneklemesine dayanmaktadır. Tipik örneklerin belirlenmesinde koşulluluk göstergesinin açık biçimde saptanabilir olması, öncül ve sonuç bölümlerinin ayrıştırılabilir olması ve örneğin hukuk söyleminde koşullu yapının işlevini göstermeye elverişli olması ölçütleri temel alınmıştır. Çözümlemede her örnek; biçimsel gösterge, öncül, sonuç, uygulanma çerçevesi ve yorum alanı bakımından değerlendirilmiştir. Bulgular, Hukuk Muhakemeleri Kanunu (HMK)da koşulluluğun açık koşul göstergelerinin yanı sıra adlaştırılmış, kalıplaşmış, olumsuz, sınırlayıcı ve normatif işlevli örüntülerle kurulduğunu göstermektedir. Ayrıca Türkçede koşulluluk kurmaya elverişli bazı göstergelerin HMK’da örneklenmemesi, koşulluluk göstergelerinin metin türüne duyarlı olduğunu ortaya koymaktadır. Sonuç olarak HMK’da koşullu yapılar, hükmün hangi durumda geçerli olacağını, hangi koşul altında sonuç doğuracağını ve hangi yorum alanı içinde değerlendirileceğini belirleyen metinsel araçlar olarak işlev görmektedir.

Abstract

The study aims to show that conditional constructions in Turkish legal discourse are used not only through explicit conditional morphemes but also as functional structures that organize the meaning, scope of application, and interpretive field of the text through antecedent consequent relations. The database consists of the main text of Law No. 6100, the Code of Civil Procedure, from Article 1 to Article 452. The provisions of the Code are examined not by legal interpretation, but in terms of which linguistic markers encode conditionality, how antecedent and consequent sections are related, and how the consequent is regulated with respect to meaning, scope of application, and interpretive field. Designed as a qualitative and descriptive linguistic study, the research employs purposive sampling. When more than one example of the same conditional marker was identified, the examples that most clearly represented the use of the relevant structure were selected. Thus, the study is based on case sampling. The selection of typical examples was guided by three criteria: the conditional marker had to be clearly identifiable, the antecedent and consequent sections had to be separable, and the example had to be suitable for demonstrating the function of conditional constructions in legal discourse. In the analysis, each example was evaluated by formal marker, antecedent, consequent, scope of application, and interpretive field. The findings show that conditionality in the Code of Civil Procedure is constructed not only through explicit conditional markers, but also through nominalized, formulaic, negative, restrictive, and normatively functional patterns. The absence of some markers that are capable of encoding conditionality in Turkish indicates that conditional markers are sensitive to text type. Finally, conditional constructions in the Code function as textual devices that determine under which circumstances a provision becomes valid, produces legal consequences and within which interpretive field it should be evaluated.
