The Delightful and Controversial Fatwa of Sheikhulislam Kemalpashazade about Marijuana and Wine

Abstract

Ottoman fatwas are generally Turkish and prose, and the number of those in Arabic or poetic is not small. In verse fatwas, a tradition in the Ottoman Empire, created a colorful environment as a genre of verse in Turkish literature. These fatwas were mostly given to the sheikhulislam or muftis who were poets because they were asked the question in verse. Since the questioner is often a poet, these fatwas have a literary conversation atmosphere and they are arranged in a certain format. The sheikhs, who had an important place among the divan poets in the Ottoman Empire, gave many poetic fatwas. Most of the verse fatwas we have introduced up to now belong to them, and this study introduces a controversial verse fatwa of Kemalpashazade Ahmed, a famous Ottoman sheikh of Islam. Kemalpashzade was one of the great sheikhulislams of the peak century of the Ottoman Empire and was known for his fatwas on critical issues. The fatwas given by Kemalpashazade, who also wrote important works in the field of langua1ge and history, on cannabis and wine were problematic and required correction. Since many fatwas were mixed with Ebussuud Efendi's fatwas in manuscripts, those who seemed problematic among them were explained and corrected by Ebussuud Efendi himself. Kemalpashazade, who also has a divan of mürettep, expressed his views on the controversial issues of that period such as cannabis, wine, devran, sema through poetry, a little jokingly, which caused serious discussions. In this study, first marijuana and then the poetic fatwas he gave about wine are examined and introduced.
